These Terms & Conditions apply to consumer and business orders placed through fotohausklinger.com. The seller is Fotohaus Klinger e.K. (trading as Fotohaus Klinger), Schloßgasse 2-4, 04109 Leipzig, Germany, represented by Robert-Michael Edel.
Any conflicting customer terms apply only if we expressly agree to them in writing. Mandatory consumer protections remain unaffected.
We aim to present product descriptions, compatibility, images, prices, and availability accurately. Images may be illustrative and colors can vary by display. Manufacturer specifications may change.
An item shown as available may become unavailable before acceptance. We will notify you and refund any payment received for an unavailable item.
Products in the store are an invitation to place an order, not a binding offer. By selecting the final order button, you submit a binding offer to buy the items shown in the order review.
An automated receipt confirms that we received the order; it does not by itself constitute acceptance. A contract is formed when we expressly accept the order, confirm dispatch, or request/accept payment for the order, whichever occurs first.
You must review and correct delivery, billing, product, quantity, shipping, payment, and total information before submitting the order. The contract language is English.
The contractual currency is EUR. Other currencies are approximate display conversions and may change with the display exchange rate.
Storefront consumer prices are gross EUR prices and include applicable VAT where required. The shipping charge, discounts, and total payable are shown before the order is submitted. International customs duties, import taxes, brokerage charges, and customer bank fees are not included unless expressly stated.
Obvious pricing errors do not bind us. If an error is discovered before acceptance, we will offer the corrected price or cancel and refund the order.
Available payment methods are displayed at checkout. Bank-transfer orders are processed only after full cleared payment is received; the order number must be used as the payment reference.
The customer is responsible for charges imposed by their bank. We may use appropriate fraud-prevention and payment-verification measures.
Processing times, destinations, shipping charges, delivery estimates, customs responsibilities, and delay terms are stated in our Shipping, Delivery & Payment policy and form part of these Terms.
For consumers, risk of accidental loss generally passes when the customer or a nominated third party receives the goods, except where the customer independently commissions a carrier not offered by us. Different statutory rules may apply to business customers.
Consumers may have a statutory right of withdrawal. Instructions and the electronic withdrawal function are available on the Withdrawal page.
Our additional 30-day return policy, eligibility requirements, exceptions, costs, methods, and refund timing are stated in the Returns & Refund Policy. Statutory rights are not restricted by the voluntary policy.
Goods remain our property until the purchase price and applicable charges for the order have been paid in full.
Mandatory statutory rights relating to defective or non-conforming goods apply. A manufacturer warranty, where offered, is additional and does not replace statutory rights.
Damage caused by misuse, unauthorized modification, failure to follow instructions, normal wear, accidents after delivery, or unsuitable third-party accessories may fall outside warranty coverage to the extent permitted by law.
Nothing in these Terms excludes or limits liability where exclusion is prohibited, including liability for intent, gross negligence, injury to life, body or health, product liability, fraud, or breach of essential contractual obligations.
For slightly negligent breach of an essential obligation, liability may be limited to foreseeable damage typical for the contract, where permitted by law. Mandatory consumer rights remain unaffected.
You are responsible for accurate account information and for keeping credentials confidential. Do not misuse the site, interfere with security, submit unlawful content, scrape protected services, or impersonate another person.
We may restrict an account or reject an order where reasonably necessary to prevent fraud, abuse, legal violations, or harm.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection granted by the law of the country where the consumer habitually resides.
We are not willing or obliged to participate in dispute-resolution proceedings before a consumer arbitration board, unless mandatory law requires otherwise.
The version shown when an order is submitted applies to that order. We may update these Terms prospectively for legal, security, or operational reasons.
If a provision is invalid, mandatory law applies in its place and the remaining provisions continue to the extent legally possible.
